The State of Solid Minerals Sector Legal and Regulatory Frameworks in Nigeria

The President of the Miners Association of Nigeria, Dele Ayanleke, has expressed apprehension regarding the current legal and regulatory frameworks governing Nigeria’s solid minerals sector. Mr. Ayanleke cited a state of confusion arising from disputes between state governments and the federal government concerning the exclusive rights to administer and control mineral resources as stipulated in the 1999 Constitution.

During the ongoing 2023 West Africa Mining Host Communities’ Indaba Conference in Abuja, Mr. Ayanleke underscored the adverse impact of these conflicting frameworks. He emphasized that the concurrent structures and frameworks would impede much-needed investments for sectoral growth and potentially exacerbate prevailing insecurity within the nation.

Ogbonnaya Orji, the Executive Secretary of the Nigeria Extractive Industries Transparency Initiative, also voiced apprehension about the vulnerable position of communities where mineral resources are extracted. He emphasized the crucial need for transparency in governing the extraction and utilization of these resources to mitigate security challenges faced by the communities.

Mr. Orji additionally addressed the security and environmental hazards associated with the mining of largely untapped mineral deposits, particularly gold. He advocated for collaboration between security agencies and mining host communities to address the pressing insecurity issues and ensure responsible mining practices.

Furthermore, he stressed the role of mining in energy transition and climate technologies, highlighting the necessity for climate-smart mining practices to safeguard vulnerable communities and the environment. Mr. Orji underscored the responsibility to govern mineral resources with transparency and accountability for the common good, equitable distribution of benefits, environmental protection, and human rights.

In conclusion, the concerns raised by Mr. Ayanleke and Mr. Orji spotlight the urgent need to address the challenges afflicting Nigeria’s solid minerals sector.
