Two Chinese Nationals Convicted and Jailed for Illegal Mining in Kwara State, Nigeria

The recent court ruling in Kwara State, Nigeria has led to the conviction and imprisonment of two Chinese nationals, Duan Ya Hong and Xiao Yi, for the illegal mining of solid minerals. Their company, Ebuy Concept Limited, was also involved in the case, which was presided over by Justice Evelyn Anyadike at the Federal High Court in Ilorin.

The convictions pertain to a one-count charge regarding the illegal mining and possession of solid minerals without the necessary licenses. The charge specifically relates to the purchase of 30 tons of minerals without lawful authority in the Kaiama Local Government Area of Kwara State.

Originally, the defendants pleaded not guilty to the charges and were granted bail on the condition of providing two sureties and paying N5 million naira each. However, they were ordered to remain in the custody of the EFCC while awaiting the completion of their bail conditions.

Upon further court proceedings, the defendants chose to change their plea to guilty for one of the amended 11-count charges. This led to a review of the case and a presentation of evidence by the EFCC, including extrajudicial statements, photographs, mineral samples, forensic reports, and more.

After careful consideration of the evidence presented, Justice Anyadike concluded that the prosecution had effectively proven its case beyond a reasonable doubt and subsequently found the defendants guilty as charged.

Consequently, Hong was sentenced to one year imprisonment with a fine of N2 million, and Yi was sentenced to one year imprisonment with a fine of N1.5 million. The court also ordered the interim forfeiture of the 30 tons of minerals and the truck used for transportation.
