Court Rules in Favour of FG and NNPCL in Oil Licence Lawsuit

The Federal High Court in Abuja has ruled on the lawsuit brought by Kaztec Engineering Ltd regarding oil mining licences in Nigeria. Justice N.E. Maha deemed the lawsuit as incompetent and ultimately struck it out, thus providing the Federal Government and the Nigerian National Petroleum Company Limited (NNPCL) with a favourable position over oil mining leases for OMLs 123, 124, 126, and 137.

The lawsuit, filed against the Federal Ministry of Petroleum Resources, the NNPCL, and others by Kaztec Engineering Ltd, sought a declaration that the award of the oil mining licenses to them dated back to as far as 2002. However, the court ruled that Kaztec failed to fulfil essential requirements, such as paying the signature bonuses for the award within the stipulated timelines. As a result, the court found the lawsuit lacked merit and was frivolous in law.

Additionally, the court noted that Kaztec failed to include necessary parties in the lawsuit, which ultimately led to the ruling that the suit constituted an abuse of the court processes. The judge ultimately struck out the suit for being incompetent.

Throughout the legal proceedings, the counsel for the NNPCL, Mr Kehinde Ogunwumiju, and other defendants had challenged the jurisdiction of the court to determine the suit. Ultimately, the court’s decision was in favour of the Federal Government and the NNPCL.
