Landmark Victory for FG and NNPCL in Legal Battle Over Oil Mining Leases

The Federal Government and the Nigerian National Petroleum Company Ltd have achieved a significant victory in a legal dispute over oil mining leases previously operated by ADDAX. This victory came as a result of a ruling by the Federal High Court in Abuja, which deemed a lawsuit by Kaztec Engineering Ltd as incompetent.

Under the leadership of Justice N.E. Maha, the court delivered a decisive ruling by striking out Kaztec Engineering Ltd’s lawsuit aimed at challenging NNPC’s statutory concession for OMLs 123, 124, 126, and 137.

The plaintiff, Kaztec Ltd, had initiated legal action against the Federal Ministry of Petroleum Resources, the Nigerian National Petroleum Company Ltd, and others in an attempt to secure a declaration that the review of the award of OMLs 123, 124, 126, and 137, which had been awarded to NNPCL in 2002, was wrongful.

In the judgment, the court emphasized that the plaintiff’s case lacked merit due to their failure to fulfil the essential requirement of paying the signature bonus, which is a condition precedent to the award of OMLs 123, 124, 126, and 137. This rendered Kaztec’s suit legally frivolous.

It was also revealed that the plaintiff failed to include necessary parties in the suit, leading the court to conclude that the entire legal action by Kaztec Engineering Ltd constituted an abuse of the court process. As a result, the court unequivocally struck out Kaztec’s suit for being incompetent, as declared by Justice Maha.

Prior to the ruling, the counsel to the NNPCL, Mr Kehinde Ogunwumiju (SAN) from Afe Babalola and Co., and other defendants challenged the jurisdiction of the court to determine the suit, based on the assertion that the suit lacked a cause of action since Kaztec, rumoured to be owned by Sir Emeka Offor, did not pay the required signature bonuses for the OMLs.

This ruling marks a significant legal victory for the Federal Government and the Nigerian National Petroleum Company Ltd and sets an important precedent in the oil and gas industry. It underscores the importance of complying with statutory requirements in matters related to the award of mining leases.

The decision by the court serves as a reminder of the legal principles that govern such transactions and reinforces the necessity of fulfilling all essential conditions in order to pursue legal action in a competent manner.
