Critical Review of Nigerian Minerals and Mining Act Essential for Sector Sanitization
The Miners Association of Nigeria (MAN) has emphasized the crucial importance of conducting a thorough review of the Nigerian Minerals and Mining Act (NMMA) 2007 to eradicate any irregularities within the sector. Mr. Dele Ayanleke, the National President of MAN, asserts that this review is essential to avert a potential constitutional crisis that could have profound economic consequences within the sector. Ayanleke underlines the need for thorough orientation on how the existing provisions of the constitution and the mining act under review can be utilized to address the current challenges in the sector.
He also underscores the necessity for proper adherence to due process during the review to ensure its efficacy. Ayanleke emphasizes that the ever-changing nature of human society necessitates periodic reviews and reforms of the system. He further states, “Hence the legal and regulatory frameworks in the national mining ecosystem, having been in place for close to two decades call for review. It is however imperative that such review must also follow the due process of the rule of law.”
In 2023, the Minister of Solid Minerals Development, Dele Alake, proposed the review of the mining law to compel investors to seek the consent of communities before applying for mineral titles. This initiative aims to address community rights and enhance local participation in the mining sector. Additionally, the Policy Dialogue on Solid Minerals organized by the House Committee on Solid Minerals in February highlighted the need for reforms in the mining law to ensure its alignment with the current realities of the country.
The ongoing efforts by the National Assembly and the Ministry of Solid Minerals Development to review the act have garnered full support from MAN. Ayanleke advocates for more robust dialogue during the review process, especially in light of the proposed involvement of state governments in mining, as mentioned in the constitutional review. Notably, the Federal Executive Council approved the proposed bill of the Nigerian Minerals and Mining Act, 2023 in April, aimed at revising the law governing the sector.
The revised NMMA is expected to address critical issues within the sector, including governance and local content, with the objective of formalizing the sector and improving relations with local communities, among other key goals.
