The Battle Against Illegal Mining: Nigerian and Chinese Nationals Face Charges in Abia State

The Federal Government of Nigeria has taken legal action against a Nigerian individual and eight Chinese nationals on suspicion of engaging in illegal mining activities in Abia State. These accused individuals are alleged to have been involved in illegal mining within the Lokpaukwu community, Umuchieze, in the Umunneochi local government area.

This action is part of the government’s ongoing efforts to combat illegal mining and regulate the minerals sector. The defendants in the case, namely Shen Yongchan, Mo Baixian, Xiao Bin, Huang Xu Fa, Ma Bingli, Yang Jian, Li Peiyin, Que Wenyong, Hiyk Edward Desmond, and Wanda Company Limited, are facing legal charges for their alleged involvement in these illegal activities.

The arrests were carried out by the Mining Marshals, a specialized security unit formed from the Nigeria Security and Civil Defence Corps (NSCDC) with the primary objective of eradicating illegal operators from the mining sector and establishing a secure environment for legitimate investors.

The trial of the Chinese and Nigerian suspects has started before Justice J.K Omotosho of the Federal High Court, Abuja. The prosecution has lodged a three-count charge against the defendants, including charges related to unauthorized mining and obstruction of lawful mining operations.

The Mining Marshals, also referred to as ‘Operation Hayakin Kogo’, were established under the leadership of the Minister of Solid Minerals Development, Dele Alake. Their efforts have resulted in the arrest of over 300 illegal miners in Nigeria since their establishment in March 2024, with approximately 133 individuals currently undergoing prosecution.

This action by the government underscores the commitment to ensuring the protection of the nation’s natural resources from illegal exploitation and holding individuals accountable for violating the law. The charges against the accused individuals represent a significant step towards achieving accountability in the mining sector.
